Terms and Conditions
These Terms and Conditions ("Terms") govern access to and use of the liquid staking protocol, including all smart contracts, interfaces, websites, and related services (collectively, the "Protocol"). By accessing or using the Protocol, you agree to these Terms. If you do not agree, do not use the Protocol.
1. Protocol Overview
The Protocol is a decentralized, non-custodial liquid staking system that allows users to stake supported digital assets through smart contracts and receive liquid staking tokens representing their staking position.
The Protocol operates on public blockchain networks and relies on validator infrastructure, smart contracts, and network-level mechanisms that are not controlled by any single party.
2. Non-Custodial Nature
The Protocol is strictly non-custodial.
- You retain sole control over your wallet and private keys
- No party can access, recover, reverse, or modify your transactions
- Transactions executed via smart contracts are irreversible
You are solely responsible for safeguarding your private keys and interacting correctly with the Protocol.
3. Eligibility & Compliance
By using the Protocol, you represent that:
- You are at least 18 years old
- Your use of the Protocol complies with all applicable laws
- You are not located in a jurisdiction where use of the Protocol is prohibited
Access may be restricted in certain jurisdictions where required.
4. Protocol Risks
Use of the Protocol involves significant risk, including but not limited to:
Smart contracts may contain vulnerabilities, bugs, or exploits that could result in partial or total loss of assets.
Staked assets may be subject to slashing, penalties, downtime, or loss due to validator behavior or network rules.
Blockchain networks may experience forks, reorgs, attacks, or upgrades that affect the Protocol or staking outcomes.
Liquid staking tokens:
- May fluctuate in value
- May lose peg or liquidity
- Do not guarantee redemption at par value at any time
Staking rewards are variable and dependent on network conditions. Returns are not guaranteed.
5. No Advice
Nothing provided through the Protocol constitutes investment, financial, legal, or tax advice. You are solely responsible for evaluating the risks of participation.
6. Fees
The Protocol may apply fees, including protocol-level or validator-related fees. All applicable fees are defined on-chain or in publicly available documentation and may change over time.
7. Upgrades & Changes
The Protocol may be upgraded, modified, or deprecated through governance mechanisms, technical changes, or network upgrades. There is no guarantee that any feature, token, or functionality will continue to be available.
8. Prohibited Use
You may not use the Protocol to:
- Engage in unlawful activity
- Exploit or manipulate smart contracts
- Interfere with network integrity or security
9. Intellectual Property
All Protocol-related branding, interfaces, and documentation are protected intellectual property, except where released under open-source licenses.
10. Disclaimer
The Protocol is provided "AS IS" and "AS AVAILABLE", without warranties of any kind. To the maximum extent permitted by law, all warranties—express or implied—are disclaimed.
11. Limitation of Liability
To the maximum extent permitted by law, no liability is accepted for any indirect, incidental, or consequential damages arising from use of the Protocol.
12. Termination
Access to user interfaces may be modified or discontinued at any time. On-chain smart contracts may remain accessible independently.
13. Governing Law
These Terms are governed by the laws of the Republic of Panama, without regard to conflict-of-law principles.
14. Legal Entity Disclosure
The Protocol is made available by TEMPEST FOUNDATION, a private interest foundation established under the laws of the Republic of Panama. This disclosure is provided solely for legal and compliance purposes and does not imply custody, control, or fiduciary responsibility.
15. Changes to Terms
These Terms may be updated from time to time. Continued use of the Protocol constitutes acceptance of the updated Terms.
16. Assumption of Risk
By using the Protocol, you expressly acknowledge and accept all risks described in these Terms and any risks inherent to blockchain-based systems, including the risk of total loss of assets.
17. No Fiduciary or Agency Relationship
Nothing in these Terms creates any fiduciary duty, partnership, joint venture, agency, or trust relationship between you and the Protocol or its operator.
18. Third-Party Dependencies
The Protocol relies on third-party blockchain networks, validators, smart contracts, and infrastructure. No responsibility or liability is assumed for failures or actions of such third parties.
19. Indemnification
You agree to indemnify and hold harmless the Protocol and its operator from any claims, damages, losses, or expenses arising out of your use of the Protocol or violation of these Terms.
20. Force Majeure
No liability shall arise from events beyond reasonable control, including network failures, protocol forks, regulatory actions, or acts of force majeure.
21. Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
